Commodatum is essentially gratuitous.




        Simple  loan  may  be  gratuitous  or  with  a


        stipulation to pay interest.









        In  commodatum  the  bailor  retains  the


        ownership of the thing loaned, while in simple



        loan, ownership passes to the borrower. (1740a)
