Notably,  in  situations  where



                          officers are covered by Section



                          38  of  the  Administrative  Code



                          of 1987 either by presumption



                          or by proof of having acted in



                          good  faith,  in  the  regular



                          performance  of  their  official



                          duties, and with the diligence of



                          a  good  father  of  a  family,



                          payees  remain  liable  for  the



                          disallowed  amount  unless  the



                          Court  excuses  the  return.  For



                          the same reason, any amounts



                          allowed  to  be  retained  by



                          payees shall reduce the solidary



                          liability of officers found to have



                          acted in bad faith, malice, and
