The exception to payee liability is
when he shows that he is, as a matter
of fact or law, actually entitled to
what he received, thus removing his
situation from Section 16.1.5 of the
RRSA and the application of the
principle of solutio indebiti. This
includes payees who can show that
the amounts received were granted
in consideration for services actually
rendered. In such situations, it cannot
be said that any undue payment was
made.
